The canal company charged 4d/ton for the delivery of coking coal to the canal bank at the coke ovens, a charge the L&BR were keen to avoid, especially as they were also meeting with obstruction from John Semple who held the leasehold title to the nearest dock and wharves. In December 1840 the L&BR acquired from John Semple and Thomas Hubert their leasehold interest in two wharves and two small basins on the north bank of the canal.

"1292. JAMES ELLIS was charged, on the Coroner's inquisition, with killing and slaying Richard Dresser.
MESSRS. BODKIN and HUDDLESTONE conducted the Prosecution.
THOMAS HUBERT . I live at No. 1, Hungerford-market, and am a lighterman and coal-merchant. I had known the deceased, Mr. Richard Dresser, about thirty years\emdash he was an accountant, and lived at No. 8, Eastcheap\emdash I saw him on Friday, the 29th of May\emdash previous to that time, when I saw him, he frequently complained of being a little poorly\emdash on the 29th of May he complained of rheumatism, as he called it\emdash he was suffering very acutely\emdash I call it sciatica\emdash I have had it myself\emdash he had been suffering from rheumatism before that, to my knowledge\emdash I was there when Dr. Ellis came to Eastcheap that day\emdash I understood that he had been sent for by the deceased and Mrs. Dxesser; also that he had been written for\emdash he told the doctor he was very glad he had come, for he was in great pain, and he thought the doctor could do him good and relieve him\emdash I think the doctor remarked that he had made up his mind that he should go down to Sudbrook-park with him that afternoon\emdash he had only complained of the pain down his legs, and the doctor said, in the most friendly way, he would drive him down in his carriage\emdash he was to meet the doctor at Sackville-street, at half-past three o'clock\emdash I did not go there with him\emdash the doctor went away soon after that, and so did I."
